Slip & Fall Frequently Asked Questions

Please reach us at fights4rights@mabjishlaw.com if you cannot find an answer to your question.

Premises liability is a legal term that describes the obligation of a property owner to ensure that their property is safe for visitors. This includes taking reasonable steps to prevent slip and fall accidents.

Under premises liability law, property owners can be held liable for injuries that occur on their property due to negligence. In order to prove negligence, the injured party must show that the property owner knew or should have known about the dangerous condition and did not take steps to fix it.

Common examples of dangerous conditions that can lead to slip and fall accidents include

  • wet floors
  • potholes
  • broken stairs

If you have been injured in a slip and fall accident, you may be able to recover damages from the property owner. An experienced personal injury attorney can help you understand your rights and options.

In order to win a slip and fall case, the plaintiff must prove that the defendant was negligent. This means that the plaintiff must show that the defendant owed a duty of care to the plaintiff, that the defendant breached that duty, and that the plaintiff was injured as a result of the breach.

In most cases, the duty of care is established by showing that the defendant had a duty to maintain safe premises and failed to do so.

For example, if a business owner fails to clean up a spill in a timely manner, he or she may be held liable if a customer slips and falls as a result.

Alternatively, if a property owner fails to fix a broken step, he or she may be held liable if someone is injured as a result.

In each of these cases, the plaintiff would need to show that the defendant knew or should have known about the hazard and failed to take action to mitigate it.

If the plaintiff can successfully prove these elements, he or she may be able to recover damages for medical expenses, lost wages, pain and suffering, and more.
